Privacy and Data Protection Policy

Privacy Policy (also referred to as a Privacy Notice) is a statement or legal document that describes the way the app collects, uses, maintains, and discloses information and data from its users. Since this application collects and stores information from its users this privacy policy is provided. We care about data privacy and security. Please review our Privacy Policy. By using the app, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use. Further, we do not knowingly accept, request, or solicit information from children or knowingly market to children. Therefore, in accordance with the laws applicable in India, if we receive actual knowledge that anyone under the age of 18 has provided personal information to us without the requisite and verifiable parental consent, we will delete that information from the app as quickly as is reasonably practical. This policy is technically a legal document, great effort had been made to craft a document that is both accurate and easy to understand, and obscuring hidden clauses in reams of text are not included in this.

Scope: By using or dealing or communicating either by user or any other person for that matter, of this application and for the matters relating to information technology and intellectual property rights shall come within the ambit of this terms of policy. The basic objectives of this policy terms is to:

Sharing of data and also withdrawal of consent.

Enumerating situation and circumstances wherein cause of action or fixation of liability likely to arise.

For the purpose of laying down a code to define and degree of care, caution and diligence to be adopted by any user using this application or dealing with app in any matter.

Provide for various aspects such as Information Technology Aspects and intellectual property law aspects i.e. trademarks, etc. in dealing with the application.

Definitions: The terms appearing in these rules shall be interpreted according to their natural meaning unless a different meaning is provided. Some of the meanings are hereby provided:

• “We”/“us”: Refers to the admin and owner of this application “Kisan Mart” and any person acting on their behalf, including employees, partners, assignees, executives, licensees, executors, etc.
• “You”/“your”: Refers to the user using this application. However, the terms “you”/“your” shall also include any person, whether being a user or not, in cases of unauthorized access, attempts to hack, violation of intellectual property rights, or other offences, regardless of whether they use the application.
• Law: Refers to the laws in force in India and the State of Telangana.
• Intellectual Property Law: Refers to various enactments, rules, regulations, and notifications issued by any authority related to intellectual property law in India, including:
  • The Copyright Act, 1957, as amended from time to time, and the Indian Copyright Rules, 1958.
  • The Trade Mark Act, 1999, as amended from time to time, and the Trade Mark Rules, 2017.
• “Application”/“App”: Refers to the “Kisan Mart” application designed for providing services through the Android platform.

Applicability: The terms of this policy is to be applied to all the users who secure access to application in any capacity either as a user by downloading the application from relevant app store or mere visitor. The terms contained herein are to be deemed as a notice to all those persons. These rules also at the same time serves as a general notice to public at large and other authorities that shows our adherence to laws, bylaws, rules and regulation issued from time to time on the covered aspects of information technology and intellectual property matters.

Privacy Rules:

• By agreeing to use this application, any person shall be construed as a user and is expected to observe these rules without any exception in their dealings with us.
• We reserve the right to change, alter, modify, add, delete, or amend the rules of this policy without prior intimation, provided it does not prejudice any person or contradict any law currently in force.
• Ensure that the information submitted or uploaded by you does not contravene or violate any law currently in force, particularly adhering to the provisions of the Information Technology Act, 2000, and the rules and regulations made or issued under it.
• While dealing with the application, availing services offered by the application, or registering as a user, the following information may be collected from you:
• User’s e-mail address.
• Mobile phone number.
• Address.
• Details of the wallet or UPI ID, etc.
• We may preserve a record of any correspondence between you and us.
• A record may be maintained and viewed by us of any orders you have made or advertisements you have placed with or through the application.
• As and when surveys are conducted or questionnaires are sent to you, we shall save your replies to any surveys or questionnaires for research purposes.
• Details of accounting or financial transactions, including those carried out through the application or otherwise.
• A report will be preserved providing details of your visits to our application and the resources that you access.
• Information we may require from you when you report a problem with the application.
• Information about you which we may receive from other sources.
• We only collect such information when you choose to supply it to us. You do not have to supply any personal information to us, but you may not be able to take advantage of all the services we offer without doing so.
• Information is also gathered without you actively providing it, through the use of various technologies and methods such as Internet Protocol (IP) addresses and cookies.
• An IP address is a number assigned to your computer by your Internet Service Provider (ISP) so you can access the Internet. It is generally considered to be non-personally identifiable information, because in most cases, an IP address can only be traced back to your ISP or the large company or organization that provides your internet access.
• We may use your IP address to diagnose problems with our server, report aggregate information, determine the fastest route for your computer to connect to our application, and administer and improve the app.

• During dealings with the application or availing services offered by the application or by registering as a user, we collect information from users, which includes: name, mobile number, address, details of the bank, email address, etc.
• The user, by accepting the terms, is deemed to grant consent for the collection and storage of data in the course of dealings with the application or utilizing services provided by the application.
• We shall use the data so collected by us for the purpose of providing services.
• We shall put in place proper systems for the security of such data entered by users and shall use reasonable diligence to ensure its privacy is secured and shall not result in a breach of privacy.
• However, we are not responsible for any breach of data if it results not due to negligence on our part but due to technical reasons.
• Data collected in the application by you shall be used without any prior notice for the following purposes:
  • In any court or tribunal as evidence.
  • With law enforcement agencies.
  • Service providers like marketing, advertising, and information technology.
  • Partners of the application or admin.
  • Third parties with whom we provide promotional offers.
  • In case of business transfers or application transfers to transferees.
• However, we shall not deal with or use this data for commercial benefits.
• We shall, when providing information from our end, ensure the correctness of the same.
• You are entitled to withdraw consent by giving intimation to us, and we shall, as far as possible, try to delete the data if requested in the proper format.
• It is mandatory for users to ensure that all the information displayed or uploaded in this application is correct and that there is no misrepresentation or attempt to engage in fraudulent acts.
• There shall be no liability on us for any fraud, misrepresentation, or untrue statement made by any delivery person.
• We commit ourselves to following the highest codes of ethics in dealing with you and expect the same from all users.
• We undertake to observe fully the Information Technology (Guidelines for Intermediaries and Digital Media Ethics Code) Rules, 2021, as applicable to us.
• We reserve the right, but not the obligation, to:
  • Monitor the app for violations of these Terms of Use;
  • Take appropriate legal action against anyone who violates the law or these Terms of Use, including reporting such users to law enforcement authorities;
  • Remove from the app or otherwise disable all files and content that are burdensome to our systems;
  • Manage the app to protect our rights and property and ensure its proper functioning.
• This app requests access to permissions or data, including functions like the camera, microphone, photos, gallery, audio, etc.
• We allow advertisers to display their advertisements in certain areas of the app. Advertisers are fully responsible for any advertisements they place on the app.
• Any unauthorized use of our name in any manner not approved by us shall not be allowed, and legal action will be initiated under applicable laws.
• You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and may use these submissions for any lawful purpose.
• We reserve the right to change, modify, or remove the contents of the app at any time or for any reason at our discretion without notice. We also reserve the right to modify or discontinue all or part of the app without notice.
• We cannot guarantee that the app will be available at all times. You may experience hardware, software, or other problems, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, or discontinue the app at any time or for any reason without notice.
• You agree that we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the app during downtime or discontinuance.
• While using the application, all users must adhere to, understand, and observe the following basic rules:
  • Usage of decent language when communicating via the app or other modes.
  • Posting any information that contains obscene content is strictly prohibited.
  • Do not use language that is abusive, threatening, or damaging to someone's reputation.
• Any person who attempts to access information in the application without authorization shall be liable to prosecution under the Information Technology Act, 2000, and relevant provisions of IPC 1908, in addition to any claims for damages.
• User shall not:
  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the application;
  • Make any modification, adaptation, or derivative work from the application;
  • Violate any applicable laws or regulations in connection with your use of the application;
  • Remove, alter, or obscure any proprietary notice (e.g., copyright or trademark);
  • Use the application for any revenue-generating or commercial purposes;
  • Make the application available over a network that permits access or use by multiple devices;
  • Use the application to create products or services competitive with the app;
  • Send automated queries to any website or unsolicited commercial emails.
• All materials in this application, including images, logos, ads, design, etc., are part of the intellectual property. Unauthorized use of these materials shall make you liable for infringement of intellectual property rights.
• Any violation of privacy rules or disregard of these terms will entitle us to repudiate the relationship, claim damages, and take legal action.
